Welcome to Chatac ("Chatac," "we," "us," or "our"). Chatac is a learning platform powered by AI that helps organizations develop, deliver, and manage learning. These Terms of Service ("Terms") govern your use of our platform, features, and tools ("Services"). By using the Services, you agree to these Terms.

1. Services & Platform Use

Chatac enables organizations to upload source materials (e.g., PDFs) to generate courses and microlessons.
Learning can then be delivered, managed, and tracked via WhatsApp and other supported integrations.

2. Subscriptions, Billing & Refunds

Plans: Chatac offers both monthly and annual subscription plans.
No Refunds: Fees are non-refundable, including for partial periods or unused services.
Cancellation: You may cancel your subscription at any time. Cancellation stops renewal at the end of the billing cycle (monthly or annual), but no refunds are provided for the current cycle.
Billing: You agree to provide accurate payment details and authorize us to charge your chosen method.

3. AI Credits & Usage

Separate Purchase: AI features (e.g., course building, tutoring, translations) require the purchase of AI credits.
No Expiration: AI credits do not expire.
Consumption: Credits are consumed as features are used. Different features may require different credit amounts.
No Refunds: AI credit purchases are non-refundable.

4. User Accounts & Responsibilities

Users must provide accurate information when registering and keep login credentials secure.
You are responsible for activity on your account.
If you enroll learners, you must ensure you have obtained proper consent for collecting their personal information.

5. Data Collection & Privacy

What We Collect:

Authentication: email, encrypted password, account verification status.
Learning Data: learner names, preferences, date of birth (for age checks), country, language, enrollment info, and uploaded content.
Business Data: billing contacts, payment info, and necessary identifiers for integrations.

What We Do Not Collect: IP addresses, device fingerprints, GPS/location data, browsing history, government IDs, or other unnecessary personal details.

Use: Data is used solely to deliver and improve the platform, support learning delivery, and manage subscriptions.
Storage: Data is encrypted in transit and at rest, hosted on Heroku's U.S. infrastructure with enterprise-grade security.
Deletion: Data may be deleted within 45 days of account termination.
No Sale of Data: Chatac never sells client or learner data to third parties.

6. Intellectual Property

Clients retain ownership of the content they upload.
Chatac only processes and stores this content to provide the Services.
Chatac retains all rights to its platform, AI tools, software, and brand assets.

7. Security & Availability

We employ enterprise-grade safeguards: role-based permissions, encryption, automated scanning, and secure hosting.
While we strive for reliability, we do not guarantee uninterrupted service.
We may update or remove features as part of platform development.

8. Disclaimers & Liability Limits

Services are provided "as is" without warranties of fitness for a specific purpose.
To the fullest extent permitted by law, Chatac is not liable for indirect, incidental, or consequential damages.
Our total liability to you will not exceed the amount paid for Services in the 12 months before the claim.

9. Termination

We may suspend or terminate accounts for nonpayment, violations of these Terms, or misuse of the platform.
Upon termination, your account and related data may be deleted after 45 days.

10. Governing Law

These Terms are governed by the laws of Massachusetts, USA.

11. Changes to Terms

We may update these Terms periodically. Updated versions will be posted here, with an updated "Effective Date."
